This website is operated by E9X Ontario. Throughout the site, the terms “we”, “us”, and “our” refer to E9X Ontario. We offer this website, including all information, tools, and services available from this site, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms, conditions, and policies referenced herein or available by hyperlink, including our Privacy Policy, Shipping Policy, and Return, Refund & Chargeback Policy.

If you do not agree to all terms and conditions of this agreement, you may not access the website or use any services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform used to sell our products and services.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your province, state, or country of residence.

You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction, including automotive regulations, consumer protection laws, or intellectual property laws.

Any breach of these Terms may result in immediate termination of your access to the Service.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time, to the extent permitted by law.

You understand that content (excluding payment information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transmission.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from E9X Ontario.

SECTION 3 – ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

Information on this site is provided for general information only. We do not guarantee that content is accurate, complete, or current.

We reserve the right to modify site content at any time without obligation to update previously published information.

SECTION 4 – MODIFICATIONS TO SERVICE & PRICES

Prices for our products are subject to change without notice.

We reserve the right to modify or discontinue the Service (or any part thereof) at any time without notice. We shall not be liable for any modification, price change, suspension, or discontinuance of the Service.

SECTION 5 – PRODUCTS & AVAILABILITY

Certain products may be available exclusively online and may have limited quantities.

All products are subject to availability and governed by our Return, Refund & Chargeback Policy.

We make reasonable efforts to display product images and descriptions accurately but cannot guarantee that your device’s display of colors, finishes, or materials will be accurate.

SECTION 6 – ORDERS, BILLING & ACCOUNT INFORMATION

We reserve the right to refuse or cancel any order at our discretion, including orders suspected of fraud, misuse, resale, or policy abuse.

You agree to provide current, complete, and accurate billing, shipping, and account information and to promptly update such information as required.

All order changes, cancellations, returns, refunds, and chargebacks are governed strictly by our Return, Refund & Chargeback Policy.

SECTION 7 – SHIPPING & DELIVERY

Shipping, delivery timelines, customs responsibilities, lost or stolen packages, damaged shipments, and address accuracy are governed by our Shipping Policy.

By placing an order, you acknowledge that:

  • Delivery timelines are estimates only and not guaranteed

  • Shipping fees are non-refundable

  • Responsibility transfers to the customer once delivery is confirmed by the carrier

SECTION 8 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or guarantees. Use of such tools is entirely at your own risk.

SECTION 9 – THIRD-PARTY LINKS

We are not responsible for third-party websites, content, products, or services. Any issues with third-party offerings must be addressed directly with the third party.

SECTION 10 – USER COMMENTS & SUBMISSIONS

Any feedback, suggestions, or submissions you provide may be used by E9X Ontario without restriction or compensation.

You are solely responsible for your submissions and agree they will not violate any third-party rights or applicable laws.

SECTION 11 – PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 12 – ERRORS, INACCURACIES & OMISSIONS

We reserve the right to correct errors, inaccuracies, or omissions and to cancel orders if information is inaccurate, including after an order has been placed.

SECTION 13 – PROHIBITED USES

You may not use this site or its content for unlawful purposes, fraudulent activity, intellectual property infringement, harassment, malware distribution, data scraping, or interference with security features.

Violations may result in termination of access to the Service.

SECTION 14 – DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

All products and services are provided “as is” and “as available”, except where required by law.

To the maximum extent permitted by applicable law, E9X Ontario shall not be liable for any damages arising from:

  • Improper installation or misuse

  • Vehicle damage, mechanical failure, accidents, or personal injury

  • Shipping delays or carrier-related issues

  • Product availability or lead times

Nothing in these Terms limits rights that cannot be excluded under Ontario or Canadian consumer protection laws.

SECTION 15 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless E9X Ontario and its affiliates from any claim or demand arising out of your breach of these Terms, violation of law, or infringement of third-party rights.

SECTION 16 – SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 17 – TERMINATION

These Terms remain effective unless terminated by you or by us.

We may terminate or restrict access without notice if we reasonably believe you have violated these Terms. All obligations incurred prior to termination survive termination.

SECTION 18 – ENTIRE AGREEMENT

These Terms, together with all referenced policies, constitute the entire agreement between you and E9X Ontario and supersede any prior agreements or communications.

SECTION 19 – GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

SECTION 20 – CHANGES TO TERMS

We reserve the right to update, change, or replace any part of these Terms at any time.

Changes take effect immediately upon posting. Continued use of the website constitutes acceptance of the updated Terms.

The version in effect at the time an order is placed governs that transaction.

SECTION 21 – USE OF PRODUCTS (AUTOMOTIVE DISCLAIMER)

  • E9X Ontario performance and cosmetic parts may be intended for off-road or motorsport use only

  • Such products may not comply with on-road regulations

  • The customer is solely responsible for ensuring legal compliance

  • We do not condone illegal use of products

  • E9X Ontario is not liable for misuse, improper installation, or resulting damages

  • Professional installation is strongly recommended

  • E9x Ontario™ makes no warranties whatsoever, expressed or implied, written or oral, with regard to the purchasers of any vehicle tuning products, and/or installations with regards to performance, safety, fit, merchantability, length of service, or for any other criteria.  Purchasers are fully responsible for vehicle maintenance to ensure tune-ability.

  • E9x Ontario™ reserves the right to terminate any and all agreements without prior notice and without incurring any obligations, to discontinue or change the services offered on this site. 

  • All tuning purchases are final, non-refundable and non-transferable.  By purchasing and or flashing your vehicle, you agree to all terms and conditions set forth.
